Welcome to Menum, a platform operated by Menum ("we," "us," or "our") accessible at Menum.store. These Terms of Service ("Terms") govern your access to and use of our website, services, and features, including creating accounts, stores, menus, products, and other functionalities. By accessing or using Menum, you agree to be bound by these Terms. If you do not agree, please do not use our platform.
1. Definitions
- Platform: The Menum website (Menum.store) and related services, including mobile applications and APIs.
- User: Any individual or entity that creates an account on Menum, including business owners.
- Content: Any text, images, or other materials uploaded by Users to their profiles, stores, menus, or products.
- Subscription Plans: The Hobby Plan (free with limited features), Growth Plan, and Business Plan, each offering different levels of access to features such as store creation, product management, QR codes, custom subdomains, analytics dashboards, and sharing links.
2. Eligibility
To use Menum, you must:
- Be at least 18 years old or have legal authority to enter into these Terms.
- Provide accurate and complete information during account creation.
- Agree to comply with these Terms and all applicable laws.
3. Account Creation and Management
- Account Creation: Users may create an account on Menum to access features such as creating, editing, and deleting stores, menus, products, QR codes, custom subdomains, and analytics dashboards.
- User Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at contact@menum.store if you suspect unauthorized use of your account.
- Content Management: Users may upload Content (e.g., text, images) for store previews, menus, product previews, and profile pictures. You retain ownership of your Content but grant Menum a worldwide, non-exclusive, royalty-free license to use, display, and distribute it solely to operate and promote the Platform.
- Content Restrictions: You agree not to upload Content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable. We reserve the right to remove or suspend Content that violates these Terms.
4. Features and Subscription Plans
- Available Features: Menum offers features including, but not limited to, creating and managing stores, menus, products, QR codes, custom subdomains, sharing links, analytics dashboards, and support for multiple languages.
- Subscription Plans:
- Hobby Plan: Free plan with limited features.
- Growth Plan and Business Plan: Paid plans offering access to additional features. Details of each plan are available on Menum.store.
- Plan Modifications: We may modify or discontinue features or plans at our discretion. We will notify Users of significant changes via email or the Platform.
5. Intellectual Property
- Menum Content: All content created by Menum, including logos, images, and website design, is owned by Menum and protected by intellectual property laws. You may not use our content without express written permission.
- User Content: You are solely responsible for ensuring your Content does not infringe on third-party rights. By uploading Content, you represent that you have the necessary rights to do so.
- Third-Party Indexing: Information on Menum, such as store and product details, may be accessed and indexed by third parties, including search engines and search consoles, as part of standard web practices.
6. Infringement Notices
- We respect intellectual property rights. If you believe Content on Menum infringes your rights, please send a notice to contact@menum.store including:
- A description of the copyrighted work or intellectual property.
- The location of the allegedly infringing Content on the Platform.
- Your contact information and a statement confirming your authority to act.
- We will review and address infringement notices in accordance with applicable laws, including the Digital Millennium Copyright Act (DMCA).
7. User Conduct
You agree not to:
- Use Menum for any illegal or unauthorized purpose.
- Attempt to gain unauthorized access to the Platform or other Users’ accounts.
- Engage in activities that disrupt or harm the Platform, such as introducing viruses or malicious code.
- Use automated tools (e.g., bots, scrapers) to access or collect data from Menum without permission.
8. Termination
- By User: You may delete your account, stores, menus, or products at any time through the Platform’s account management features.
- By Menum: We may suspend or terminate your account or access to the Platform for violations of these Terms, suspected fraudulent activity, or at our discretion with notice.
- Effect of Termination: Upon termination, your right to access Menum ceases, but these Terms’ provisions regarding intellectual property, liability, and dispute resolution will survive.
9. Privacy
Your use of Menum is subject to our Privacy Policy, available at Menum.store/privacy. The Privacy Policy explains how we collect, use, and protect your personal information.
10. Disclaimers
- Menum is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.
- We do not guarantee the accuracy, completeness, or availability of the Platform or its features.
- We are not responsible for User Content or third-party actions, including indexing by search engines.
11. Limitation of Liability
To the fullest extent permitted by law, Menum and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including loss of data, profits, or business opportunities. Our total liability will not exceed the amount you paid to Menum in the preceding 12 months.
12. Indemnification
You agree to indemnify and hold Menum, its affiliates, and employees harmless from any claims, damages, or losses arising from your use of the Platform, your Content, or your violation of these Terms.
13. Governing Law and Dispute Resolution
